These Terms and Conditions (the Terms) govern your access to and use of the Trading Hall website(s), applications, and related services (collectively, the Services) provided by The Trading Hall, an Ontario sole-proprietorship with our registration address located at 1864 Jubilee Dr London, ON N6G 0H6 CANADA. (The Trading Hall, we, us, our).
By clicking “I agree,” creating an account, purchasing a subscription, or using the Services (other than to review these Terms and our Privacy Policy), you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
1. Definitions
- Site means our website(s) and any subdomains we operate.
- Services means our Site, community areas, live sessions, replays, educational content, scanners, charts, alerts, journaling, analytics, automation features, and any related support.
- Content means all information and materials available through the Services, including videos, text, images, charts, templates, tools, code, communications, and other content we provide or that users post.
- User Content means content you submit or post through the Services, including chat messages, comments, uploads, profile details, and feedback.
2. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms and update the “Last updated” date. Your continued use of the Services after changes take effect means you accept the updated Terms.
3. Important risk disclaimer, not financial advice
Trading and investing involve substantial risk. You can lose money, including more than your initial investment where leverage is involved. You are solely responsible for your trading decisions, position sizing, risk management, and outcomes.
Trading Hall is an education and information platform. We are not registered as an investment advisor, broker dealer, or dealer representative. Nothing in the Services constitutes financial, investment, legal, tax, or accounting advice, or a solicitation to buy or sell any security, derivative, futures contract, forex product, or any other financial instrument. Past performance is not indicative of future results. Any examples, scenarios, alerts, tools, or automation outputs are for educational purposes and do not guarantee any outcome.
4. Eligibility
You must be at least the age of majority in your jurisdiction to use the Services. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
5. Accounts and account security
To access parts of the Services, you must create an account. You agree to provide accurate and current information and to keep your login credentials secure.
- One account per person unless we approve otherwise in writing.
- You may not share your login or subscription access.
- You are responsible for all activity under your account, whether authorized or not.
- Notify us immediately if you suspect unauthorized access.
We may suspend or terminate accounts for suspected fraud, abuse, or Terms violations.
6. Subscriptions, billing, renewals
6.1 Subscription plans
We may offer monthly, annual, or other subscription plans. Features can vary by plan and may change over time.
6.2 Payment authorization
You authorize us and our payment processor to charge the subscription fees, applicable taxes, and any other authorized charges to your chosen payment method.
6.3 Taxes
Prices may be subject to applicable taxes (including HST), which will be calculated at checkout where applicable. Our membership fees are inclusive of HST.
6.4 Renewals
Unless otherwise stated at checkout, subscriptions renew automatically at the then-current rate until cancelled. You can cancel in your account settings or by contacting support at info@tradinghall.net.
Cancellation stops future renewals. You keep access until the end of the current paid term unless we terminate earlier for a Terms violation.
6.5 Failed payments
If a payment fails, we may retry the charge and may suspend access until payment is received.
7. Refund policy
All fees are non-refundable except where required by law or as explicitly stated in a written refund policy presented at checkout.
If you offer a limited refund policy, insert it here with clear conditions (example: time window, content access limits, coaching attendance limits).
8. Acceptable use and community conduct
You agree to use the Services only for personal, non-commercial use unless we approve commercial use in writing.
You agree not to:
- share, resell, or redistribute access to the Services or Content
- record, download, or redistribute live sessions or replays except where we explicitly allow it
- scrape, data mine, reverse engineer, or attempt to extract source code or proprietary logic
- post or transmit unlawful, abusive, harassing, hateful, discriminatory, or obscene content
- impersonate others, misrepresent affiliation, or attempt to deceive users
- solicit other users for competing services, promotions, or recruiting without written permission
- upload malware or attempt to disrupt the Services
- attempt unauthorized access to accounts, systems, or networks
We may remove content, restrict features, mute users, or suspend or terminate accounts at our discretion for violations.
9. Tools, alerts, scanners, journals, and automation features
The Services may include market tools such as scanners, charts, journaling, analytics, alerts, and optional automation features.
You understand and agree:
- Alerts may be delayed, missing, inaccurate, or unavailable at times.
- Market data can be delayed or incomplete depending on data sources and third-party systems.
- Automation features are tools to assist execution or workflow, not guarantees of fills, timing, pricing, or outcomes.
- Third-party platforms (brokers, prop firms, APIs) can reject, modify, or delay orders for reasons beyond our control.
- You are responsible for ensuring your use of any tools or automation complies with the rules of any broker, prop firm, exchange, or third party you use.
We do not represent that the Services are compatible with all brokers, prop firms, platforms, or rulesets. If your broker or prop firm takes action against you, you remain responsible for your account and compliance.
10. No guarantees, no promises
We do not guarantee any trading outcome, profitability, or performance. We do not guarantee that any strategy, tool, alert, or automation configuration will produce a particular result.
11. Intellectual property
The Services and Content, including all related software, designs, tools, templates, workflows, branding, and documentation, are owned by Trading Hall or its licensors and are protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Services and Content for your personal use during an active subscription, subject to these Terms.
You may not reproduce, distribute, create derivative works from, publicly display, or commercially exploit the Services or Content without our prior written consent.
12. User Content and license
If you post User Content, you retain ownership of your User Content, but you grant Trading Hall a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content as needed to operate the Services, enforce these Terms, and improve the Services.
Do not post content you do not have the right to share.
13. Moderation
We may moderate community areas and live sessions. Moderation decisions are final. We are not obligated to provide reasons for removals or restrictions.
14. Privacy
Our Privacy Policy explains how we collect, use, and disclose personal information. The Privacy Policy is incorporated by reference into these Terms.
15. Communications and anti-spam compliance
You consent to receive service communications related to your account, subscriptions, and platform updates. Marketing emails will include an unsubscribe option. We comply with applicable Canadian anti-spam rules.
16. Third-party services and links
The Services may include links to third-party websites, tools, or services. We are not responsible for third-party content, availability, terms, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.
17. Service availability, changes, and discontinuation
We may change, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted or error-free operation.
18. Suspension and termination
We may suspend or terminate your access to the Services immediately if we believe you have violated these Terms, engaged in fraud or abuse, or created risk to the Services or other users.
Upon termination, your license to use the Services and Content ends and you must stop using them.
19. Disclaimer of warranties
To the fullest extent permitted by law, the Services and Content are provided “as is” and “as available.” We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
20. Limitation of liability
To the fullest extent permitted by law:
- Trading Hall and its owners, directors, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, trading losses, lost opportunities, or lost data arising from your use of the Services.
- Our total liability for any claim arising out of or related to the Services will not exceed the lesser of CAD $100 or the total fees you paid to us in the six (6) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
21. Indemnity
You agree to defend, indemnify, and hold harmless Trading Hall and its related persons from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- your use or misuse of the Services
- your violation of these Terms
- your User Content
- your violation of any third-party rights or laws
22. Governing law and venue
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute will be brought in the courts located in Ontario unless we both agree to an alternative dispute resolution process. If you want an arbitration clause, add it here with counsel review.
23. Miscellaneous
- These Terms are the entire agreement between you and Trading Hall regarding the Services.
- If any part is found unenforceable, the rest remains in effect.
- We may assign these Terms. You may not assign them without our written consent.
- Our failure to enforce any provision is not a waiver.
